Court Sacks PDP House Of Representatives Member From Enugu State

The Member representing Igboeze North/Udenu federal constituency in the House of Representatives, Hon. Simon Atigwe has been sacked by the Court of Appeal sitting in Enugu.
In its ruling on Wednesday, the appellate court declared Hon. Dennis Nnamdi Agbo of the Labour Party (LP) as the rightful winner of the election and reinstated Him.
Didactic Information Hut recalls that Hon. Agbo who was initially declared the winner of the 2023 election and sworn into office, was later sacked following a rerun election in February 2024, paving way for the subsequent swearing in of PDP’s Atigwe as the winner. However, Agbo filed a petition contesting the rerun results, citing irregularities in vote computations and violations of the Electoral Act.
The Appeal Court agreed with Hon Agbo and ruled that the rerun election was not conducted in compliance with the electoral laws and found that Atigwe was not duly elected by valid votes.
Earlier, the tribunal led by Justice H.N. Kunaza, in its judgment had said that over 2,000 votes were wrongly added to Atigwe’s tally, and the original February 2023 results were restored, showing Agbo with 28,870 votes compared to Atigwe’s 14,229.
The Appeal Court subsequently ordered that the certificate of return issued to Atigwe be withdrawn and a new one be issued by the Independent National Electoral Commission (INEC) to Hon. Dennis Agbo.
